Can a founder in India apply?
The published Delaware and Wyoming formation materials focus on the entity, its name, the filer or organizer, and a registered agent with a physical in-state address. Neither lists US citizenship as a formation requirement. From those materials, we infer that a founder living in India can submit an application.
That is our reading, not a promise from either filing office. The office reviewing the filing decides whether to accept it, and all current state and federal rules still apply. Check the Delaware Division of Corporations or the Wyoming Secretary of State before filing.
What to prepare
State filing versus bank verification.
The state filing and the later bank or processor review ask for different things. Keeping them separate avoids mistakes.

One consistent identity across every record
Preserve the complete passport name, including middle names and expanded initials, and use one consistent address representation across every record.

Separate the state filing from provider verification
The state filing typically does not require an identity-document upload. Banks and payment processors review identity separately, may request government ID, may ask follow-up questions, and may decline.

Ownership and governance information
Record who owns the company, each ownership share, and how decisions will be made. The short public filing is not the complete private governance record.

Registered agent and honest business details
Delaware and Wyoming require a registered agent with a physical in-state address. Arrange that separately, then prepare working contact details and a plain description of what the company does.
State and entity: a decision, not a ranking.

The EIN, without an SSN.
The EIN belongs to the company, not to you. IRS Form SS-4 asks you to identify a responsible party — the individual who ultimately owns or controls the entity. That is not automatically the person completing the form. If the responsible party has no SSN or ITIN and is ineligible for one, the current instructions allow “foreign” or N/A on line 7b.
The online EIN assistant is not available to applicants with no US legal residence, principal place of business, or principal office. Those applicants must use another current IRS method. What remains, in both countries.
Forming a US entity does not replace what you owe at home. Indian tax, reporting, currency, ownership, and funding questions need a qualified local adviser. A practical question for your Indian adviser: what records should you keep for ownership and funding of the US entity? Get that advice before funding or operating the US entity.
In the US, foreign qualification, licenses, and tax depend on where and how the company operates. Form 5472 may apply to a foreign-owned US entity. Provider onboarding is a separate decision; see US bank accounts for non-residents. Recurring state compliance continues after formation; start with keeping your LLC in good standing. Treat each issue as fact-dependent, not as a fixed answer.
