A tax treaty is an agreement between the United States and another country that adjusts how certain income is taxed when it flows between the two. Its purpose is to keep the same money from being taxed twice by two countries at full force. The US maintains treaties with many countries, but by no means all of them.
A treaty is not a blanket exemption. It is a document of specific articles β one covering business profits, another dividends, another how a resident is defined β and each article has conditions. Whether a treaty helps you depends on which country you're from, which article applies, and whether you meet its terms.
What it can change for your LLC.
A treaty can change how much of your company's income is taxable in the US versus your home country, and sometimes whether you have to file in the US at all for certain types of income. It can also affect your personal tax position as the owner β and this is where an ITIN often enters, because claiming a treaty benefit usually means identifying yourself to the IRS.
None of this is automatic. A treaty benefit typically has to be claimed β reported on a return or a form β not simply assumed because your country has a treaty with the US. If you skip that step, you may be treated as though no treaty applied.
